Pure FlashCrew Digital Program Terms and Conditions

NO PURCHASE NECESSARY. INTERNAL TRADE PROMOTION ONLY. NOT OPEN TO THE GENERAL PUBLIC. BY
PARTICIPATING IN THIS PROMOTION, YOU AGREE TO THE FOLLOWING TERMS & CONDITIONS. VOID WHERE
PROHIBITED.

These are the official rules (the “Official Rules”) for the Pure Storage, Inc. (“Pure”) Pure
FlashCrew Digital program (the “Program”). The Program is being sponsored by Pure, which
maintains an office at 650 Castro Street, Mountain View, CA 94041. The Program is void where
prohibited or restricted by law, is subject to applicable federal, state, and local statutes, rules,
regulations, and other laws (each a “Law”), and is governed by these Official Rules. By
participating in the Program, you agree to be bound by these Official Rules and by the decisions
of Pure which are final and binding in all respects pertaining to the Program. Participation by
Pure Partners in the Program is not intended to, and shall not create any employment, agency,
or similar relationship between the Partner and Pure and is not mandatory. Website
administrators and Reward vendors are not sponsors of this Program.

Program Period. The Program begins on January 22, 2021 and will continue indefinitely with
annualization on the first day of each Pure fiscal year (the “Program Period”).

Acceptance of the Official Rules; Program Site Policies; Laws. By participating in the Program,
you agree to be bound by these Official Rules and by the decisions of Pure which are final and
binding in all respects pertaining to the Program. Participation in the Program also is governed by
the terms of use pertaining to the Pure Program website https://purestorage.influitive.com (the
“Program Site”) which may be viewed on the Program Site. The collection, use, and disclosure of
information obtained online from Participants in the Program on the Program website is governed by
Pure’s Privacy Statement, which may be viewed at https://www.purestorage.com/privacy.html (such
Privacy Statement and the Program Site terms and policies are referred to in these Official Rules as
the “Policies”). In the event there is any inconsistency between any of the Policies or any Program
promotional materials and the terms and conditions of these Official Rules, these Official Rules shall
prevail and govern. By participating in the Program, you agree to comply with any and all applicable
Laws in connection with your participation in the Program.

Program Eligibility. Through the Program, Pure will enable Participants to earn points
(“Points”) for successfully completing certain specified events, including but not limited to:
discussions, surveys, activities, referrals, challenges (“Event”) you complete or participate in.
The Points are used for ranking the in the FlashCrew Digital leaderboard. Pure in its sole
discretion determines the Point values associated with each Event. Points may be eligible to be
redeemed for certain rewards that may be offered from time to time (“Rewards”), at Pure’s sole
discretion.

Participant must be an employee of a customer of Pure to be eligible to participate in the
FlashCrew Digital Program and must be 18 years old, a legal resident of the country where
Partner resides. If you leave your employer such that you are no longer a Pure customer, you
must promptly notify Pure of this change via email at flashcrew-digital@purestorage.com. Employees
of Government or government-owned entities may participate in the Program, but shall not
receive any gifts or items of value in association with the Program. Pure wants to ensure that
we, and you, comply with applicable government gift and ethics laws. In the event that you
receive a gift or promotional item of value, please immediately contact Pure at
flashcrew-digital@purestorage.com. If you believe this item is not within your agency guidelines, we
encourage you to request approval from your ethics officer or designated executive responsible
for your organization’s gift/ethics policy before you accept the item, and to determine whether
you can accept the item. Each Partner must follow its employer’s rules (including its social
media policies) when participating in the Program and redeeming Points. The following are NOT
eligible to participate in the Program: Pure employees, vendors, suppliers, online platform
providers, website administrators, advertising and promotion agencies, nor any other company
or organization involved with the design, sponsorship, or operation of the Program, as well as
their respective officers, directors, employees, and agents (collectively, the "Program Parties"),
and immediate family and household members of such individuals.

How to Participate. You may participate in the Program by following the instructions in the
email you received from Pure inviting you to join the Program. To create a free Account, you
must register with the Program Site and provide your name and email address. In addition, you
may be asked to answer whether you are employed by a governmental or state owned entity
and whether your employer allows you to receive gifts and prizes. You may only possess one
Account at a time. Multiple Participants are not permitted to share the same Account.

Social Media. By participating in the Program, you agree to abide by all of the terms and
conditions applicable to any social media platform you use in connection with your participation
in the Program. Any posts, tweets or other statements you make through the Program Site,
through social media (e.g., LinkedIn, Facebook, Twitter, Instagram, or Pinterest) (“Social
Media”), or otherwise in order to participate in the Program must be truthful and not misleading,
must indicate that they are part of the the Program, and otherwise must comply with all
applicable Laws, including without limitation any Laws regulating customer endorsements and
testimonials. You agree to and be subject to the terms and conditions of the applicable social
media platform. By participating in the Program, you agree to abide by all of the terms and
conditions applicable to any social media platform you use in connection with your participation
in the Program. Any posts, tweets or other statements you make through the Program Site,
through social media, or otherwise in order to earn Points or participate in the Program must be
truthful and not misleading, must indicate that they are part of the Pure FlashCrew Digital
Promotion, and otherwise must comply with all applicable Laws, including without limitation any
Laws regulating customer endorsements and testimonials. For example, a complete Challenge
via Twitter would consist of: a tweet via Twitter that contains the content set forth in the
particular Challenge, includes the hashtags #PureFlashCrewDigital and #Promotion and tags @PureStorage.
Your tweets may be required to be viewable by Pure in order to receive Points.
This may require you to change your account settings so that your tweets are “unprotected”
and/or “public.” As another example, one or more Challenges may ask you to refer Pure to
friends or colleagues who you believe may be interested in learning more about Pure’s products
or services. You must not send any unsolicited marketing messages to anyone who you know
does not wish to receive them and you otherwise must comply with all applicable Laws
regarding the sending of unsolicited marketing communications.
